These terms govern your use of Mercur and the orders you place through it. Please read them: placing an order means you accept them.
Using Mercur
Mercur operates the marketplace platform: the catalog, search, basket, payments and account tools. You may use Mercur to browse, compare offers and buy from the sellers listed on it. You agree to provide accurate account and delivery details and not to misuse the platform (fraud, scraping at scale, or interfering with other buyers and sellers).
Orders & contracts
A listing is an invitation to buy. A contract of sale is formed when the seller of an item confirms your order. Because a basket can contain items from several sellers, a single checkout can create several separate contracts, one per seller, even though you pay once.
Marketplace sellers
For every item, the seller of that item is the contracting party and is responsible for the product, its description, dispatch, invoicing and warranty. First-party items are sold by Mercur; third-party and certified-refurbished items are sold by the seller named on the listing. Mercur verifies sellers and provides buyer protection, but is not itself a party to third-party contracts of sale.
Pricing & taxes
Prices are shown in US dollars and include applicable VAT. Delivery cost is shown before you confirm the order. If you need a VAT invoice, you can add your company name and Tax ID at checkout or from the order afterwards.
Example Tax ID (NIP) format: PL 000-000-00-00.
Liability
Sellers are liable for the conformity of the goods they sell. Mercur is liable for the operation of the platform and for the buyer-protection commitments it makes. Nothing in these terms limits your mandatory rights as a consumer under applicable EU and Polish law, including statutory warranty and the right of withdrawal.
Changes to these terms
We may update these terms; the version that applied when you placed an order governs that order. This version is effective May 12, 2026.
